Supreme Court Public Camping Law Ruling

In 2019, the Ninth Circuit Court of Appeals (Martin vs. Boise) ruled that cities could not enforce public camping ordinances against homeless individuals whenever the number of homeless individuals in a jurisdiction exceeded the number of “practically available” shelter beds.

On June 28, 2024, the United States Supreme Court overturned that decision, allowing cities to enforce local anti-camping ordinances once again. The Court underscored that public camping regulations are a valid tool for local governments to uphold public health and safety without unfairly targeting homeless individuals. This decision highlights the intricate balance between the rights of homeless individuals and the broader community interests.

The City of Fullerton is committed to supporting those experiencing homelessness, offering a range of resources. The Fullerton Police Department works closely with the HOPE Center, a key partner in this endeavor, which has the capacity to dispatch mobile homeless outreach units, staffed with social workers, mental health professionals, homeless liaison officers, and community service providers, to any location across the region, ensuring that those in need receive the support they require. The city employs a Homeless Outreach Coordinator, participates in the Fullerton Navigation/ Recuperative Care Center in Fullerton, and also collaborates with shelters in neighboring cities that border it.

Fullerton has existing Municipal Codes (FMC 9.12.230 FMC 8.40.010 and FMC 7.108) that allow for enforcement of camping and obstructing in a public area. The Fullerton Police Department remains steadfast in its commitment to supporting those experiencing homelessness, while balancing the need to keep our community safe and maintaining the quality of life our residents expect. Through collaborative efforts with community partners, innovative outreach initiatives, and appropriate, thoughtful enforcement, the City of Fullerton strives to address homelessness while upholding the dignity and rights of every individual in our community.
